VA Financial Products Distribution LLP ("VA LLP”/”we”/”our"/”us”) is a mutual fund distributor (ARN 129800) registered with Association of Mutual Funds in India (AMFI) and is also engaged in providing other financial and related services. To enable this, VA LLP would need to complete user’s (“you”/”your”) Know Your Clients (KYC) in accordance with regulatory/government and legal agencies and authorities; your Personal Data may be provided/verified or updated in this process with respective regulatory agencies as per the regulations applicable at that time. This Privacy Policy outlines how VA LLP collects, uses, disclose, and safeguard your data when you use services or interact with us through the website or any other platforms.

VA LLP is governed by the provisions of applicable laws in India including the Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and and Digital Personal Data Protection Act, 2023 and such other rules/regulations (Collectively hereinafter referred to as “Applicable Law(s)”), as amended from time to time, to maintain the privacy of your Personal Data. We collect and process your Personal Data only to the extent necessary for VA LLP to process your requirement(s) in accordance with such Applicable Laws. In case you choose not to share your Personal Data as required by VA LLP, VA LLP may not be able to provide you the services.

VA LLP collects and generates various data points about you. Data by which you are identified is termed as “Personal Data”. Personal Data does not include the Data that is freely available or accessible in the public domain. Your privacy is of utmost importance to us and the protection of your Personal Data is a key commitment for VA LLP.

Information/Personal Data collected by VA LLP:

Personal Data that VA LLP may collect from you includes, but are not limited to, the following:

  • Personal details (e.g. name, contact details including, residential address, date of birth, documents such as identity card/passport details / Aadhaar details / PAN / Voter ID/driving license, and/or education details) provided by you to VA LLP to avail various services from VA LLP.
  • Your details including transaction history, balances and payment details, for effecting transfer of monies through various payment channels facilitated by VA LLP.
  • Financial details (e.g. income, expenses, networth,Financial objectives, and/or credit history) needed as part of the request for some of VA LLP’s products/services.
  • Information you provide when you register to use our Websites/application, subscribe to our mailer list, email us, arrange project viewings with us, request brochures from us.
  • Images/videos of documents/photos required to avail any of VA LLP’s products/services.
  • Voice recordings of conversations with VA LLP’s customer care agent by you to address your queries/grievances.
  • Risk Profile, investment selection, beneficiary and nominee data etc.
  • Geolocation Details
  • Personal information voluntarily submitted by you through forms, calls, emails, or during your interactions with VA LLP’s representatives or digital platforms.
  • Employment details (e.g. occupation, employer name, positions held, employment history, salary and/or benefits, if any) as part of VA LLP’s record retention for credit / various product evaluations or as required under applicable law including Prevention of Money Laundering (Maintenance of Records) Rules, 2005.
  • Specimen signature(s) or consent for the processing of your instructions received by VA LLP through the various payment and delivery channels.
  • Timestamp including IP Address and Geolocation details of the system.
  • Opinions provided by you to VA LLP by way of feedback or responses to surveys.
  • We may receive your data from third parties, including business partners, analytics providers, and other agencies working with us.

Usage of Your Personal Data:

Subject to applicable laws, VA LLP use your Personal Data in a fair and reasonable manner in its business operations for providing its services and to perform, among other actions, the following:

  • To offer and facilitate transaction of services tailored to your investment needs, in line with applicable laws and regulatory guidelines.
  • To check and process your requests submitted to VA LLP for products/services and/or instructions or requests received from you in respect of these products/services.
  • To share with you, updates on changes to the products/services and their terms and conditions.
  • To provide you with transaction and post transaction-related services, providing, improving, and marketing our products and services, including site content and performance;To complete the registration process to access the services and to auto populate relevant fields in the course of the interface of VA LLP’s platform.
  • To take up or investigate any complaints/claims/disputes.
  • To respond to your queries or feedback submitted by you.
  • To verify the identity and perform due diligence as mandated by regulatory authorities. This includes compliance with Know Your Customer (KYC), Anti-Money Laundering (AML), and related norms issued by SEBI, AMFI, and other relevant bodies.
  • To carry credit checks, screenings or due diligence checks as lawfully required by VA LLP.
  • To monitor and review services from time to time.
  • For conducting audits and for record-keeping purposes.
  • To undertake financial/regulatory / management reporting, and create and maintain various risk management models.
  • To ensure compliance with applicable legal and regulatory obligations, including disclosures to statutory authorities such as SEBI, the Financial Intelligence Unit – India (FIU-IND), and other government agencies, as required under law.
  • To conduct internal audits, assess service performance, analyze trends, manage risks, enhance operational efficiency, and improve the quality, safety, and effectiveness of our offerings. This may also include anonymized data analysis for research and development purposes.
  • For selective offers and promotions.
  • To fulfill the requirements of applicable laws/regulations and/or court orders /public orders/ regulatory directives received by VA LLP /protect and defend the rights or users of VA LLP.
  • For any other matter incidental and associated with the above.

Other Websites:

The Website/Application might contain links to other websites/applications. Once you have left the website/application  of VA LLP, you should check the applicable privacy policy of the third party website/application to determine how they will handle the Personal Data they collect from you. VA LLP is not responsible for the privacy practices followed by such third parties or the content of such third-party websites/applications.

Sharing of Personal Data:

VA LLP may share Personal Data of users with the following parties, in connection with and as may be necessary for the conduct of VA LLP’s business and operations:

  • With the Registrar & Transfer Agents (RTAs) of Mutual Funds and/or other issuers, clearing corporations, exchanges, depositories, banks, NBFCs, financial institutions, group companies, associate entities, authorised intermediaries, cloud service providers, and any other external service providers involved in transaction processing, dispatches, printing, marketing, or related services, unless the user specifically writes to VA LLP to refrain from sharing their Personal Data.
  • With statutory, regulatory, administrative, or legislative authorities including KYC Registration Agencies, the Central KYC Registry, or as required under applicable laws, for the purpose of identity verification, compliance with legal, regulatory, or anti-money laundering/KYC requirements, and/or for data storage.

VA LLP shares such aforesaid Personal Data to the aforesaid service providers under strict confidentiality and only on a 'need to know basis' and for the purposes of lawful functioning of VA LLP’s business/operations. VA LLP sends the account statements or financial information pertaining to the users to be sent over the internet and only through a secure mode.

VA LLP also ensures that the parties to whom such aforesaid Personal Data is shared have confidentiality provisions and high levels of security practices, controls and procedures to ensure its protection.

Notwithstanding anything contained, VA LLP shall not be responsible/liable, either directly or indirectly, for the authenticity/accuracy of the Personal Data submitted by you and/or for its misuse, not attributable to the acts of VA LLP, at any time and in any manner whatsoever.

Data Storage and Reasonable Security Practices and Procedures:

VA LLP stores and processes your Personal Data only in India. VA LLP’s data center and systems also maintain backup and disaster recovery systems in India.

VA LLP takes various steps and measures to protect the security of your Personal Data from misuse, loss, unauthorised access, modification or disclosure. VA LLP uses the latest secured server layers encryption and access control on its systems.VA LLP safety and security processes are audited by a third-party cybersecurity audit agency from time to time.

VA LLP has provided multiple levels of security to safeguard your app by the Login / Logout option. VA LLP also ensures the device binding so that the same login cannot be used on different devices without any additional authentication / OTP. Please do not share your VA LLP login, password and OTP details with anybody.

However, VA LLP shall not be held responsible for any loss, damage or misuse of your Personal Data, if such loss, damage or misuse is attributable to a Force Majeure Event. A "Force Majeure Event" shall mean any event that is beyond the reasonable control of VA LLP and shall include, without limitation, sabotage, fire, flood, explosion, pandemic, epidemic, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.

Retention of Personal Data:

VA LLP shall store and retain your Personal Data as long as required to accomplish the purpose for which it was collected or otherwise for the period to the extent permitted under the applicable laws.

Upon completion of the retention period of personal data as described above, VA LLP shall delete or destroy, to the extent technically possible, personal data in VA LLP’s possession or control, so that it no longer constitutes personal data.

Your Rights in relation to Your Personal Data :

You have the right to correct, amend, complete and update of Personal Data for the processing of which has previously given consent. You represent that the Personal Data you provide from time to time is and shall be correct, current and updated and you have all the rights, permissions and consents to provide such Personal Data.

In addition to the rights detailed above, you may also have the right to revoke or withdraw your consent to the processing of your Personal Data. With this, VA LLP  will no longer share your data with any of the parties involved in providing the services. However, VA LLP  may retain your Personal Data as long as the purpose for its usage exists, after which the same is disposed of except for any record retention required by Applicable Laws.

VA LLP  will facilitate your request to exercise such rights subject to the provisions of applicable laws relating to the processing and storage of Personal Data . If you wish to exercise any of the rights, please write an email, providing in as much detail as possible, the right(s) you wish to exercise.

Communications From VA LLP:

VA LLP may from time to time contact you via calls, SMS, emails, and other communication channels to provide you with information pertaining to VA LLP’s Services, notifications on updates vis-à-vis VA LLP Services (when VA LLP considers it necessary to do so), educational information and promotions.

This policy will be reviewed by VA LLP as and when required and the same may change at any time.

The latest and the most updated policy can always be found at VA LLP’s website/application. While VA LLP will make reasonable efforts to keep you posted on any updates to this privacy policy, to make sure that you are aware of any changes, it is recommended that you review this policy periodically.

This Privacy Policy shall apply uniformly to VA LLP’s desktop website, mobile applications and any services provisioned by VA LLP on its platform.

By accepting this Privacy Policy, you expressly consent to VA LLP’s use and disclosure of your Personal Data in the manner prescribed in this Privacy Policy. Your consent shall be considered as free, specific, informed, unconditional and unambiguous and shall signify an acceptance/agreement to the processing of the Personal Data for the specified purpose.
